By accepting this participant agreement below, you agree to the following terms and conditions: Kaptiva Sports Travel, S.L., a company of Kaptiva Sports, provided with the Tax Identification Number B-65843799, with corporate address at c/ Aragó 271 Pral 2ª, 08007, Barcelona, Spain and with license as tour operator number GCMD-567 duly provided by the Catalan Tourism Authorities, is a Spanish corporation (“we” or “us”) provides the KSA Residential Camp described in the website www.kaptivasportsacademy.com. These terms and conditions apply to the KSA Residential Camp named on the Guest Reservation and Payment Form (the “KSA Residential Camp” ) and the program for this KS Residential Camp (the “Preliminar Schedule”).
Reservations and Deposits:
A deposit of 350 € per participant (except when otherwise noted in writing by us) and a completed online Registration Form (“Registration Form Information”) are required together with this Participant Agreement to reserve space for the KSA Program. The balance of the Program payment price (“KSA Residential Camp Fees”) is due 60 days before the KSA Residential Camp start date (as listed on the Program). If we do not receive full payment by 60 days prior to the KSA Residential Camp start date, we may cancel your reservation and retain the deposit. All prices are in € (Euro). Except as expressly stated in the Program, you are solely responsible for any KSA Residential Camp-related costs that you incur.

If a player reserves a place on the KSA Residential Camp program and subsequently cancels, the following refund policy will apply: Notification of cancellation must be made in writing to KSA Residential Camp Admissions, C/ Aragó 271 Pral 2ª, 08007 Barcelona, Spain. Cancellations are effective on the date that KSA Residential Camp receives written notification. There will be no refunds for players who voluntarily cancel for any reason from a KSA Residential Camp program, nor will there be any refund for a player who is asked to leave a program for the use of drugs or alcohol, non-notification of a serious medical condition, or gross disobedience of the rules of the program (decisions which are at the sole discretion of KSA Residential Camp). No refunds will be submitted for players that suffer an injury during the program.
Data Protection:
Kaptiva Sports Travel SL hereby informs you that the activities of Kaptiva Sports Travel described on the websites www.kaptivasportsacademy.com are carried out in Spain and, therefore, are subject to EU and Spanish data protection and e-communications privacy laws. More specifically, governed by Regulation (EU) 2016/679 of April 27, 2016 (RGPD), the Organic Law 3/2018 of December 5 (LOPDGDD) and other legal regulations in force on the protection of personal data.
Kaptiva Sports Travel SL, (hereinafter Spain) holds a file of personal details listed with the Spanish Data Protection Agency. The purpose of its creation is to process all information on people interested in taking part in the programs, courses and activities of Kaptiva Sports Travel SL and other activities provided by the company. Spain also informs those taking part in its programs, activities and services provided by Kaptiva Sports Travel SL.
You details will be transmitted via a secure server only from your country of origin to Spain and vice versa. The recipients of the information are members of Kaptiva Sports Travel SL and sporting professionals to provide the aforementioned services, as well as official public and private organizations requiring the transfer of data by law. Refusal by the interested party to provide the details requested shall result in our services being unable to assist ordinarily.
The interested party is entitled to exercise his/her rights to access, rectify, cancel and oppose, as established by Spanish Act 15/1999 of 13 December and Spanish Royal Decree 1720/2007 of 21 December by contacting the holder of the file, Kaptiva Sports Travel SL, by post at C/Aragó 217, Pral 2a, 08007 Barcelona (Spain) or by e-mail at info@kaptivasportsacademy.com, including a copy of his/her National ID Document or equivalent.
Pursuant to the aforementioned, I hereby agree and expressly authorize Kaptiva Sports Travel SL to process my details and transfer them to the appropriate companies, professionals and official public and private organisations to provide the service requested.
Operator Cancellation or Substitution:
We may cancel any KS Residential Camp at any time before departure, including the number of participants signed up for a given KSA Residential Camp to be insufficient to operate such KSA Residential Camp. In this case we have established the minimum number of participants to operate the program in 20 participants. We will make commercially reasonable efforts to keep the Itinerary as it has been published; however, the final Itinerary may vary due to factors beyond our control. We may in our sole discretion substitute services or goods of similar quality for any service or good stated in the Itinerary. If KSA Residential Camp is cancelled, our liability is limited to a full refund of your deposits and KS Residential Camp price. If for reasons beyond our control, a KSA Residential Camp in progress must be interrupted or cancelled, we will in good faith consider refunding a portion of the KSA Residential Camp price depending on our actual costs incurred compared to the KSA Residential Camp as originally contemplated.
Additional Cancellation Insurance:
We strongly encourage you to purchase cancellation and interruption insurance and additional health insurance to protect against financial loss from unforeseen accidents, illness, and/or loss of baggage: you declare, you have been informed on the possibility of contracting a cancellation and interruption insurance and additional health insurance, likewise of the coverage, exclusions, general terms and particular conditions of said Insurance policy.
Accommodations:
Standard Guest accommodations during the KSA Residential Camp for players are double or twin occupancy and will include fully equipped, en-suite bathrooms.
Certification of Participant’s Health; Responsibility to Inform Operator of Disabilities:
By signing below and/or tendering any portion of the KSA Residential Camp Price to us, you certify that you do not have any condition or disability that would create a hazard for you or others participating in the KSA Residential Camp, and that you understand that health care standards, facilities, and services abroad may be different or even inadequate for treating certain health conditions. You agree to inform us via certified mail or e-mail sent to camps@kaptivasports.com (with confirmation of receipt thereof from us) at the time you tender your first payment of the KSA Residential Camp Fee (or at such later time when you become aware of such a condition) of any existing physical or mental illness, disability, or any other condition for which you may require medical attention or special accommodation during the KSA Residential Camp. We make no guarantee to be able to accommodate you for such condition during the KSA Residential Camp, and we make no representations or warranties regarding special accommodations or handicap accessibility on the KSA Residential Camp.
Participant Misbehavior:
Alcohol, drugs and tobacco are strictly forbidden during camp. Participants must respect the other participants and camp staff and follow the daily planning of the camp and rules. Any serious misbehavior will be subject to immediate expulsion. Parent or Guardian will be immediately notified and will have to purchase the return ticket.
Athletics Release:
You hereby acknowledge that playing or practicing soccer is a potentially hazardous activity. You agree that you are voluntarily entering and assuming all risks associated with participating in those activities, including but not limited to falls, contacts with other participants, the effects of weather including heat and or humidity, and the conditions of the training grounds and facilities, all risks being understood and appreciated by you. Having read this waiver, and knowing these facts, and in consideration of Kaptiva Sports Travel acceptance of this application, you hereby waive and release the Kaptiva Sports Travel S.L. and its representatives from all claims and liabilities of any kind arising out of your participation in soccer playing, practicing, swimming or training.
Responsibility/Liabilities:
We act only in the capacity of agent for the suppliers of the travel services named in the Itinerary or otherwise providing services or goods, such as hotels and other lodging providers, camp operators, sight seeing trip operators, bus lines, car rental companies, driving services, restaurants, and providers of entertainment. We assume no responsibility for any personal injury, property damage, or other loss, accident, delay, inconvenience, or irregularity which may be occasioned either by reason (1) any act or omission of any of the Suppliers (2) any matter beyond our exclusive control. We have no special knowledge regarding the financial condition of the Suppliers, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which you may travel. You assume full and complete responsibility for checking and verifying all passport and visa requirements of the destinations and for complying with all laws of the country in the Itinerary. You are also responsible for respecting the authority and following the directions of the KSA Residential Camp guide during KSA Residential Camp. We may exclude you from participating in all or any part of the KS Residential Camp if, in our sole discretion, your condition or behavior renders you unfit for the KSA Residential Camp or unfit for continuation once the KSA Residential Camp has begun. Unfitness may include, without limitation, any behavior that, regardless of its cause, is inappropriate or offensive or interferes with the delivery of KSA Residential Camp services, or may constitute a hazard or embarrassment. In such case, our liability shall be strictly limited to a refund of the recoverable cost of any unused portion of the KSA Residential Camp. Should you decide not to participate in certain parts of the KS Residential Camp or use certain goods included in the KSA Residential Camp, no refunds will be made for those unused parts of the KSA Residential Camp or goods. The client will be responsible for any cost, damages or losses arising out of his actions or omissions.
General:
Any dispute related to the KSA Residential Camp shall be governed by Spanish law without regard to conflict of laws principles. The courts in Barcelona, Spain shall be the exclusive forum for any lawsuit related to the KSA Residential Camp, and you consent to the personal jurisdiction by said courts. You agree to present any claims against us within 30 days after the KSA Residential Camp ends and to file within one year of the incident, and you acknowledge that this expressly limits the applicable statute of limitations to one year. You agree to grant us (and third parties with whom we may engage in joint marketing) a worldwide, royalty-free, fully paid up license to use your photographic, video, or digital likeness solely for our promotional and/or commercial purposes. Facsimile transmission of any signed document shall be deemed delivery of an original. At our request, you shall promptly provide an original document as well. If there are any conflicts between this Participant Agreement, the Reservation Form, and the Itinerary, this Participant Agreement shall apply.
Image rights:
In accordance with the provisions of Regulation (EU) 2016/679 of 27 April 2016 (RGPD), the Organic Law 3/2018 of 5 December (LOPDGDD) and other current legislation on the protection of personal data and the right to one’s own image (Organic Law 1/1982 of 5 May) we inform you that KAPTIVA SPORTS, S.L. requests your consent to record the image of your child and publish it in a clearly identifiable way, in the photographs and recordings corresponding to the activity of KSA One Week Program, and that are publicly exposed in the different media used by Kaptiva Sports and its collaborators in order to disseminate the project and its social purposes.
Unless you tell us otherwise, these images will be kept properly protected and stored. They will not be communicated to third parties, except by legal obligation, nor will any international transfer of data take place without your prior consent. Once the images are no longer needed, they will be stored properly blocked with appropriate security measures.
Likewise, we inform you that you have the right to request the access, rectification, portability and suppression of the data and the limitation and opposition to its treatment by contacting KAPTIVA SPORTS, S.L., with address at C/Aragó, 217, pral 2a 08007, Barcelona or by sending an e-mail to info@kaptivasports.com, together with a photocopy of your ID card or analogous document in law, indicating the type of right you want to exercise. You have the right to withdraw the consent given at any time. The withdrawal of consent will not affect the lawfulness of the processing previously carried out. You also have the right to file a complaint, if you consider that the processing of personal data does not comply with the regulations in force, before the Supervisory Authority (www.aepd.es).
